The contribution of the generation of Tâbi’un in the formation of Islamic sciences in general and in the development of hadith in particular is known. Various studies have been done on the quality of this contribution. Being a part of such an aim is among the targets of this study as well. Not to conducted any work on the hadithism of especially Abdullah b. Abbas' student and after him Atâ ibn Abi Rabah who the most famous teacher of the Mecca (...) school was another encouraging reason. While examining the life and scientific personality of Ata who was one of the early personalities, it has been tried to reach some results with the information obtained from the sources from the first period, especially the fatwa and rumors belonging to him. Atâ who was leading an observable, active political life, lived in the intellectual and social turmoil that emerged in the early period. Atâ who drawing attention with his educator personality, added his own experiences to the scientific heritage he received from the companions in the first instance Ibn Abbas, and had been passed it on to the next generations. Being a fatwa authority in Makkah mufti and pilgrimage organizations for many years is one of his important experiences. In addition to being well-known for his devotion to the Sunnah, he has been taken place between those known among the generation of Tâbi’un with his fatwa and ijtihad. Ata, who is a critical hadith reciter, is accepted as the absolute authority in the hadith. The fact that he was one of the first to make talfiq in the hadith shows that he knew the diversity of the sources he reported and the many tarikh of the narrations. He wrote narrations and encouraged writing of hadith. He contributed to the development of hadith terms with some of the hadith concepts he used and drew attention with the abundance of mursal hadiths. (shrink)

Purpose. The study is aimed at highlighting in the historical-comparative context the influence of anthropological teachings on the development and formation of such a legal phenomenon as "legal certainty", proving that the category of legal certainty appeared as a consequence of anthropocentric philosophical approach in law. Theoretical basis. In the article, using the system approach, the content of the term "legal certainty" was analyzed. The axiological approach allowed generalizing various manifestations of legal certainty within the limits of one va-lue concept (...) and generalizing it by formulating and emphasizing the importance of the anthropophilosophical approach in the study of legal phenomena. The method of comparison, analysis, synthesis, generalization of philosophical concepts was used, in which the principle of legal certainty was expressed in different periods of historical development. Originality. This article supports a wide approach to understanding the principle of legal certainty, and the latter one relates to general theoretical legal principles. It is alleged that legal certainty consists of a number of requirements for lawmaking and law enforcement. In conducting a historical analysis for these requirements of legal certainty, it was established that they were historically originated and developed as a part of anthropological philosophical doctrine and subsequently embodied in law. The connection with anthropological teaching in jurisprudence is transformed into a relationship between the realization of the principle of legal certainty and human rights. Conclusions. Anthropological approaches in the study of legal phenomena allow providing value humanistic orientation to law. Human rights and freedoms as the most important social value require observance of them even when the legislation is imperfect, uncoordinated, contains gaps and uncertainties. The principle of legal certainty enables to overcome these difficulties, due to it the requirements of lawfulness and observance of human rights and freedoms are agreed upon. This principle is generally legal, and its content is revealed through a set of components – requirements. (shrink)

Objectives: The aim of this study is to find and compare the current situation between common people and healthcare providers’ preferences for a good death in the context of Chinese culture. Methods: A cross-sectional anonymous questionnaire survey covering 190 ordinary Chinese people and 323 healthcare providers was conducted. An inventory of the good death was translated and the subjects were surveyed about their attitude toward it. Ethical considerations: Permission to conduct the study was granted by department chiefs, nurse managers and (...) the participants themselves. The participants were informed that they took part on a voluntary and anonymous basis, that they could withdraw at any time, that they had the right to ignore questions they did not wish to answer, and that whatever they chose to do would not jeopardize their employment conditions. Results: The attributes that were perceived as important by major respondents for a good death were maintaining hope and pleasure, good relationship with medical staff, good relationship with family, independence, environment comfort, being respected as an individual, preparation for death, physical and psychological comfort, dying in a favorite place, and not being a burden to others. And some relatively less important characteristics were life completion, receiving enough treatment, natural death, controlling over the future, unawareness of death, pride and beauty, feeling that one’s life is worth living, and religious and spiritual comfort. We also found that healthcare providers were more likely than general out-patients to perceive “physical and psychological comfort,” “dying in a favorite place,” “good relationship with medical staff,” and “natural death” as important for a good death. Conclusion: This study offers healthcare providers in China a fundamental understanding of the normal expectations of the general public for a good death. It is believed that these findings in our study are valuable to improve palliative care in China. We compared the attitudes of Chinese and Westerners and found some differences, which suggested that cultural difference should be an important consideration to achieve a good death in China. We also found that healthcare providers see good death differently from general public, indicating that the criteria for good death warrant further study. (shrink)

ABSTRACT While philosophers have highlighted important reasons to resist one’s own oppression, they tend to overlook the phenomenon of complacency about one’s own oppression. This article addresses this gap by arguing that some oppressed agents are obligated to resist complacency about their own oppression because failing to do so would significantly harm themselves and others. Complacent members of oppressed groups fail to resist meaningfully, are self-satisfied, and are epistemically culpable. I contend that focusing on the obligation to combat complacency is (...) useful for at least two reasons. First, complacency about one’s own oppression is a distinctive phenomenon that warrants separate philosophical attention. Second, focusing on the obligation to resist complacency helps analyze an undertheorized group of oppressed agents by challenging the binary understanding of power prevalent in the literature on the duty to resist, thereby sharpening philosophical accounts of resistance and filling a gap in a prominent well-being-based theory of resistance. The volitional theory of human action has formed a basis for a prominent account of voluntary behavior since at least Aquinas. But in the twentieth century the notions of will and volition lost much of their popularity in both philosophy and psychology. Gilbert Ryle’s devastating attack on the concept of will, and especially the doctrine of volition, has had lingering effects evident in the widespread hostility and skepticism towards the will and volition. Le dialogue requiert au moins deux personnes. Encore faut-il s'entendre, notamment dans le dialogue interreligieux, sur la définition de la "personne". Rien là d'évident, contrairement aux apparences : à chaque définition du Dieu vivant correspond une définition du croyant dans chaque fibre de son être. D'où la nécessité d'une anthropologie du dialogue, où chacun s'interrogerait : "Y a-t-il réciprocité, de sorte que lui et moi nous considérions comme des égaux?" Cette anthropologie, l'auteur, dès les années 1960, a entrepris de la (...) fonder, en conjuguant Tradition musulmane et philosophie occidentale (française principalement). Homme de foi, il présente d'abord l'islam d'une façon claire et synthétique, mettant en relief la dimension de témoignage ; puis il examine les réserves que l'islam peut rencontrer chez un Occidental (transcendance et athéisme, statut de la femme, de l'esclave, des minorités...) ; enfin, face au danger de dépersonnalisation de la culture musulmane, il tente de montrer en quoi l'islam est une "religion d'espoir".
